Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the MDG University mobile application and this website (together, the "App"), operated by My Digital Group ("My Digital Group", "we", "us" and "our"). By accessing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility and authority
You must be at least 18 years old to use the App. If you are using the App on behalf of a business or another person, you confirm that you are authorised to accept these Terms on their behalf.
2. Your account
Some features of the App require you to create an account. You agree to provide accurate information and to keep it up to date. You are responsible for keeping your sign-in details secure and for activity that happens under your account. Please tell us promptly if you believe someone has accessed your account without your permission.
3. Licence to use the App
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the App for your own learning and for running your business, in line with these Terms. This licence does not allow you to resell, redistribute, sub-licence, or commercially exploit the App or its content, or to make it available to others outside your organisation.
4. Acceptable use
When using the App, you agree that you will not:
- Use the App in any way that breaks the law or infringes the rights of others;
- Copy, reproduce, distribute, or publicly share the App's content except as we expressly allow;
- Attempt to reverse engineer, decompile, or access the source code or underlying systems of the App;
- Interfere with, disrupt, or place an unreasonable load on the App or the systems that support it;
- Access the App through automated means (such as scrapers or bots) without our written permission;
- Use another person's account without authorisation, or share your account details with others; or
- Upload or transmit anything harmful, misleading, or unlawful.
We may suspend or restrict access if we reasonably believe these Terms are being broken.
5. Educational content
The App provides general educational and informational content to help you run and grow your business. This content is provided for guidance only and is not professional, legal, or tax advice tailored to your situation. Outcomes depend on many factors that are outside our control, so we do not promise any particular result. You are responsible for how you apply what you learn.
6. Intellectual property
The App and its content - including text, video, graphics, logos, course materials, and software - are owned by or licensed to My Digital Group and are protected by intellectual property laws. Except for the licence granted in these Terms, all rights are reserved. You may not remove or alter any ownership notices.
7. Content and feedback you provide
If you submit content through the App (for example, notes, responses, or messages to support), you keep ownership of it, but you grant us permission to use it as needed to operate and improve the App. Any ideas, comments or suggestions you share about the App may be used by us without any obligation to you.
8. Third-party services
The App may include or link to services, content, or features provided by others. We do not control those third parties and are not responsible for them. Your use of any third-party service may be governed by that party's own terms and privacy policy.
9. Availability of the App
We work to keep the App available and reliable, but we may update, change, suspend, or withdraw all or part of it at any time, including for maintenance or improvements. We are not responsible for any loss caused by the App being temporarily unavailable.
10. Disclaimers
To the extent permitted by law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, secure, or without errors, or that the content will be accurate, complete, or current. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, My Digital Group will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, or goodwill, arising from or related to your use of the App. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant part of the App or its content. This clause does not limit any rights you have under the Australian Consumer Law that cannot be excluded.
12. Indemnity
To the extent permitted by law, you agree to reimburse us for reasonable losses and claims arising from your misuse of the App or your breach of these Terms or of any law.
13. Suspension and termination
You may stop using the App at any time. We may suspend or end your access to the App if you breach these Terms, if required by law, or if we reasonably need to. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and My Digital Group submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from them.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, let you know through the App. Your continued use of the App after an update means you accept the revised Terms.
